Process Service Help for those Filing PRO SE – How Do I Serve Documents?
The parties to the case cannot serve copies on the opposing party. There are three most often used means of serving process.
- Hand delivery
- Certified mail restricted delivery
- Sheriff
There is another much easier alternative, using a third-party process server. Process Servers do this for a living. Many are used to dealing entirely with the legal profession. Most Process Servers that deliver for individuals that are filing pro se tend to be smaller businesses, or individuals and lack resources to execute quickly, or to deal with any unusual circumstances.

The requirements to be a third-party process server vary by county. The state does not dictate who may be a process server. Check with your local courts if there’s any question about someone being allowed to serve papers in that county. The general requirements across all counties are:
- 18 years old or older
- No mental or legal disability
- Permanent Florida resident
- Clean background check
- Passage of an exam
- Certificate of Good Conduct

Hand delivery requires that a copy of the court summons, complaint, and other papers are physically delivered to the other side. The process server may be able to deliver the copies to another adult living in the same home, but that service can only happen if the process service is at the other parties home. Finally, as much as possible, make sure that the process server is trustworthy, and has the resources to deal with the unexpected! A botched service of process can lead to your case being “quashed.” In other words, it can cost you your case.
