Replevin, commonly referred to as a claim or delivery, is a concept that few people outside the legal field are familiar with. Primarily, Replevin is a legal remedy, which permits a person to recover personal property, which was taken unlawfully or wrongfully.
However, unlike trespass or trover suits, the main purpose of the Replevin court proceeding is the return of the actual property and not monetary damages.
Historically, replevin actions were grounded in common law, but now replevin actions generally fall under each state’s civil procedure statutes.
In Florida, Replevin is coverted by Title VI, Civil Practic and Procudreu, Chapter 78, Replevin.
